UPON part hearing the preliminary issue set forth in the said order dated the 19th day of July,1995 ("the order") this day in presence of Counsel for the Defendant and for the Third Party And having heard Counsel Upon consideration had thereof IT IS ORDERED that the answer to the question set forth in paragraph 1 (i) of the order namely whether Section 35 and Section 38 of The Trustee Act 1961 render the purported retirement of George Ramsey Martin Moore on 28th day of October 1983 ineffective and void is in the negative AND IT IS FURTHER ORDERED that:-

1. the Defendant do on or before the 30th day of June 1996 serve his Reply to the Defence and Counterclaim of the Third Party

2. the determination by the Court of the question set forth in paragraph 1 (ii) of the order be adjourned to the Call Over to be held on Friday 13th September 1996 in Committee Room 2, Top Floor, Illiam Dhone House, Circular Road, Douglas at 9.45 a.m.
