WILL
QUESTIONNAIRE - Please send us an email with your numbered replies
to the following numbered questions
1. YOUR FULL NAME, ADDRESS AND CONTACT TELEPHONE NUMBER/EMAIL
ADDRESS
2. PLEASE GIVE A BRIEF SUMMARY OF YOUR ASSETS WITHIN THE ISLE
OF MAN AND THEIR APPROXIMATE VALUE
3. FULL NAME OF ALL THOSE PERSONS YOU WISH TO BENEFIT together
with their addresses and their relationship to you.
What do you want them to inherit - a named asset, a proportion
of your assets (if so how much), or all your estate in the Isle
of Man after testamentary expenses?
If you want children to inherit please give details as to what
age you want them to inherit at if they are under 18 (ie 18 (minimum),
21,25 etc).
If you have (or may have in the future) grandchildren do you
wish them to inherit their respective parent's share should that
parent die before you or do you want your remaining children to
inherit that child's share?
4. THE FULL NAMES AND ADDRESSES OF EXECUTORS
These are the people who ensure that the terms of your Will are
carried out. They should be people you have confidence in and
can rely upon to carry out the terms of your Will. Whilst your
Husband/Wife/Partner can act in this capacity for you, we would
recommend that you also appoint at least one person to act should
your Husband/Wife/Partner die before you or simultaneously with
you.
If you have children under the age of 18 at the time of your
making the Will, you should appoint 2 executors. The task of being
an executor is not an easy one, and we would suggest that you
discuss this with your chosen executors before appointing them,
and also, perhaps, consider leaving them something for the work
they will have to do.
You should consider having at least one Manx resident executor,
so that probate and other documents can be quickly signed and
decisions taken. Furthermore you should remember that your estate
is "resident" for tax purposes in the country in which
the executors reside. The Isle of Man only levies income tax at
a maximum rate of 18% making it a very tax efficient country for
estate management. Conti Advocates are happy to advise and assist
executors of estates, or to act as professional executors should
you want.
5. IF THERE ARE ANY CLOSE FAMILY MEMBERS YOU SUPPORT FINANCIALLY
WHO YOU DO NOT WISH TO MAKE PROVISION FOR IN YOUR WILL, PLEASE
GIVE DETAILS as to their full names, addresses, relationship to
yourself and whether you want a clear statement in your Manx Will
that it is your intention not to leave them any assets. Be aware
that certain close family members whom you have maintained financially
may be able to attempt to have part or all your Manx Will set
aside.
6. HAVE YOU EVER MADE ANY SUBSTANTIAL GIFTS TO ANY OF YOUR
CHILDREN ie providing the deposit for a house, buying a car, paying
for through university which your other child or children may
not have had? If so, do you want this to be taken into consideration
when dividing up your assets between your children, or not? Please
give details as to which child received what substantial financial
help during your lifetime.
